Offending religious feelings, as referred to in Article 196 of the Polish Penal Code, was criminalized as follows: ‘Any person who offends the religious feelings of others by publicly insulting an object of religious worship or a place dedicated to the public celebration of religious rites shall be liable to a fine, restriction of freedom or imprisonment for a term not exceeding 2 years.’ This study highlights some doubts concerning the protection of freedom of conscience and religion using the example of the crime of offending religious feelings and attempts to prove the necessity of such protection in the Republic of Poland, a democratic state ruled by the law. W artykule przedstawiony został casus jednego z zakonników Kościoła Katolickiego. Zdaniem autora przypadek ten dobrze ilustruje realia, w jakich przyszło żyć duchowieństwu w Polskiej Rzeczypospolitej Ludowej. Wojciech Kloc, ze Zgromadzenia Braci Albertynów, prowadził handel dewocjonaliami w celu zarobienia pieniędzy na remont dachu domu zakonnego. Z tego powodu został zatrzymany przez milicję przed jednym z kościołów w Kędzierzynie (powiat kozielski), gdzie odebrano mu dewocjonalia, którymi handlował oraz pieniądze, które przy nim znaleziono. Kazus G. J. dotyczy dyskryminacji nauczycielki, która dwukrotnie zdjęła ze ściany pokoju nauczycielskiego krzyż. Swoje zachowanie tłumaczyła negatywnymi skojarzeniami z tym symbolem religijnym. Została ukarana dyscyplinarnie przez dyrekcję szkoły, co uznała za dyskryminację jej osoby ze względu na jej bezwyznaniowość. Złożyła do sądu pozew o odszkodowanie z tytułu molestowania w miejscu pracy i uzyskała korzystne dla siebie rozstrzygniecie. Po prawomocnym zakończeniu sprawy wniesiona została skarga nadzwyczajna do Sądu Najwyższego z wnioskiem o uchylenie wyroku całości i orzeczenie przez Sąd Najwyższy co do istoty sprawy. The chapter examines some controversial decisions by the Spanish Tribunal Supremo on freedom of thought in a question related to education, in which freedom of conscience was advanced. In questo ambito, è da ricordare la conferenza su "Conscience de soi e connaisance de soi", tenuta il 2 giugno del 1947 nella sede della Société Française de Philosophie. The Patres ecclesiae?s works were a frequent topic of discussion at the time in which many humanists stood against the decadent medieval scholastics. That Juan Luis Vives was part of this tradition is demonstrated in his commentaries on Saint Augustine works. Despite its pedagogical function, the scholia of the Valencian author became quite subjective. In this sense, his ecdotic work or, specially, his «criticisms and censures» can be mentioned. Here, Vives strongly disapproves of the intense political and intellectual turmoil of his epoch. Celem opracowania jest ukazanie na przykładzie jednego z zakonników sposobu postępowania Służby Bezpieczeństwa wobec duchownych, którzy znaleźli się w spektrum zainteresowania tej instytucji, z uwagi na podejrzenie prowadzenia „antypaństwowej” działalności.
